Executive Orders on DEI: Implications for Higher Ed Grant Recipients Under Title VI

The diversity, equity and inclusion (DEI) landscape has changed dramatically for institutions of higher education since the January 2025.

This webinar will focus on how the following three executive orders have reshaped how colleges and universities must think about their obligations under Title VI of the Civil Rights Act of 1964, as recipients of grants and other federal funding:

  • EO 14173 – “Ending Illegal Discrimination and Restoring Merit-Based Opportunity”
  • EO 14168 – “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government”
  • EO 14281 – “Restoring Equality of Opportunity and Meritocracy”

We will discuss the requirements of each of these executive orders, including the requirement that grant recipients certify under the False Claims Act that they do not maintain any DEI programs that violate federal anti-discrimination laws, including Title VI.  We will then discuss the programmatic reviews that colleges and universities have undertaken to assess their grant programs under these executive orders, as well as how higher ed can respond when faced with immediate terminations of grant agreements.  We hope this discussion will arm all participants with an understanding of the practical steps higher ed can take to assess their programs and make any necessary changes to ensure compliance with the new requirements.  Finally, we will update the participants on the legal status of the executive orders, as various organizations have challenged the constitutionality of many of the Administration’s executive orders.
